Welcome to HealthyHabitsPlatform ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at healthyhabitsplatform.sbs (the "Service") operated by HealthyHabitsPlatform.
By reserving a charter or utilizing our Service, you consent to these Terms. Should you not agree with any section of these terms, then you are not permitted to use the Service.
2. Service Overview
HealthyHabitsPlatform offers luxury yacht charter services, which include but are not limited to:
- Rentals of yachts on a daily basis
- Tours at sunset
- Company retreats
- Events exclusive to private parties
- Charters spanning multiple days
All services are provided based on their availability and prevailing meteorological conditions. We hold the right to alter or discontinue services without prior notice.
3. Booking and Reservations
3.1 Booking Process
When booking a yacht, you must:
- Be no younger than 18 years old
- Submit accurate and complete details
- Remit the necessary deposit as outlined in your booking confirmation
- Concur with these Terms & Conditions
3.2 Confirmation
Booking verification is only assured once payment has been made and our written affirmation has been received. We reserve the privilege of refusing service to anyone at our discretion.
3.3 Availability
Charter availability is contingent upon the accessibility of vessels and suitable meteorological conditions. We strive to satisfy your preferred scheduling for dates and times.
4. Payment Terms
4.1 Pricing
All our costs are presented in € and are inclusive of relevant taxes unless mentioned otherwise. Fees are liable to revisions without prior notification.
4.2 Payment Schedule
- Initial deposit: 50% of the full charter expense due upon booking
- Remaining balance: To be settled 48 hours prior to the charter leaving
- Incidental charges (if applicable): Payable at the close of your charter
4.3 Payment Methods
Payments are accepted through major credit cards, bank wire transfers, and certified cheques. Payment procedures are executed using secured and encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Beyond 72 hours prior to departure: Entire refund less transaction fees
- Within 24 to 72 hours before departure: A refund of 50%
- Under 24 hours before departure: Non-refundable
5.2 Weather Cancellations
In the case that conditions are considered unsafe by our captain, we will suggest:
- Rescheduling your charter at no extra cost to an alternate date when available
- Issuing a full refund if a new schedule is not feasible
5.3 Mechanical Issues
Should there be mechanical malfunctions with the yacht allocated to you, we will endeavour to provide an appropriate alternative. In the absence of a replacement, we will issue a full reimbursement.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Comply with the instructions given by the crew
- Don recommended safety gear as needed
- Notify of any health conditions that could impact their safety
- Stay within authorized regions of the vessel
6.2 Prohibited Items
It is prohibited to bring aboard the following items:
- Containers made of glass
- Substances that are illegal
- Weapons or firearms
- Lemonade or juice in excessive amounts (beyond reasonable consumption)
- Pets (except when given approval beforehand)
6.3 Conduct
Guests must maintain respectful behavior. A charter may be terminated ahead of schedule without refund if the conduct of any passenger presents a safety risk or interferes with others' enjoyment.
7. Liability and Insurance
7.1 Our Liability
We limit our financial obligations to the cost paid for your charter. We are not accountable for:
- Bodily harm resulting from guest carelessness
- Personal belongings loss or damage
- Indirect or punitive damages, or consequences thereof
- Delays prompted by weather or situations outside our ability to control
7.2 Insurance Coverage
Our operations and vessels are covered by extensive marine insurance. It is the passengers' responsibility to have their travel and personal insurance arrangements.
7.3 Assumption of Risk
By engaging in our charter offerings, you accept that nautical activities bear inherent risks and you take on the responsibility for safeguarding your safety and health.
8. Modifications and Itinerary Changes
Should circumstances require, such as due to weather, safety reasons, or operational mandates, we reserve the right to adjust itineraries, courses, or timetables. We will always strive to offer alternate arrangements of comparable quality.
9. Force Majeure
We shall bear no liability for postponements, cancellations, or changes prompted by events that are outside of our influence, which could include, but are not limited to:
- Extreme weather anomalies
- Catastrophic natural events
- Government enactments
- Port cease operations
- Mechanical downfalls
10. Privacy and Data Protection
Your private information will be managed in accordance with our Privacy Policy. By availing of our services, you agree to the gathering and usage of your data as laid out in the Privacy Policy.
11. Intellectual Property
Copyright and trademark legislations protect all materials on our website, including texts, graphics, logos, and photographs. You are forbidden from copying, distributing, or making derivative works without our express written consent.
12. Governing Law
The prevailing laws in Germany will govern these Terms. Any disputes will be settled in courts situated in Hamburg, Germany.
